How is Settlement going to change according to the White Paper?

The White Paper, released in May outlines a series of proposed changes and reforms to the current immigration system. All major immigration categories are set to change including Settlement. Below, we outline the key changes:

What are the proposed changes?

Earned Settlement

The government has proposed an ‘earned settlement’ model to replace the current system. Under the current system, individuals qualify for settlement based on the length of time they have spent in the UK. However, this could change.

The government no longer feels that this criteria reflects their ‘strongly held belief that people should contribute to the economy and society before gaining settled status in the U.K’‘. This statement from the White Paper reflects the governments sentiment that Settlement is a ‘privilege and not a right’.

If the proposed changes come into effect, the government will reform the current rules by introducing an ‘Earned Settlement’ model. Under this model Settlement rules will be reformed by falling under the Points Based system. The expansion of the Point-Based System will increase the standard qualifying period to ten years.

Stricter English language requirements

As part of the proposed points based system for Settlement the English language requirements will change.

Individuals will have to demonstrate progression in their English language proficiency over time if they apply for settlement.

Currently, there are no requirements on English proficiency. However, under the new rules, main applicants and dependants will have to take assessments of improvements over time to demonstrate progress.

How will this impact your settlement application/route to settlement?

If the proposed changes come into effect, individuals will have to ‘earn their right’ to settlement through long term contributions to the U.K. This could be demonstrated in several ways. For example, through long term employment to demonstrate economic contributions through tax and societal contributions such as charitable work etc…

Shorter pathways will continue to be offered to those who qualify for the 5 year route. Individuals will have the opportunity to reduce the new 10 year period based on the Points Based contributions to the U.K.

Why are the government proposing these changes?

The governments case for reforming and tightening up Settlement and introducing the ‘earned Settlement’ model is to ‘foster integrity and cohesion’.

The government believes that introducing these measures will encourage individuals to integrate and contribute to their local communities and the wider country.

As a result of the increased levels of net migration between 2019 to 2024, the government predicts that more people are likely to become eligible for settlement and then citizenship. Therefore, by implementing the ‘earned settlement’ model.

When will the proposals come into effect?

There is no fixed date aid out for any of the White Paper proposals. Changes are expected to come in between now and 2029. However, some changes may be introduced within the new few weeks. Keep an eye out on our social media pages and our website for updates on when the changes begin to come into effect.
